How long does בין השמשות last?

  • רבי יהודה holds that בין השמשות begins either at שקיעת החמה or when פני מזרח מאדימין  ends, and  הכסיף תחתון ולא הכסיף עליון.
    • It ends when השוה עליון לתחתון. The entire sky is dark.
    • It comes out that בין השמשות is a total of 2/3 or ¾ of a מיל.
    • מחלוקת ראשונים if להלכה it’s a ספק if it’s 2/3 v.s. ¾ or we pasken like רבה that it’s ¾.
  • רב נחמיה holds בין השמשות begins at שקיעה and lasts for ½ מיל
  • רבי יוסי holds בין השמשות lasts for a moment (כהרף עין)

What’s the ספק of בין השמשות?

  1. יום
  2. לילה
  3. Part יום part לילה

What’s the נ”מ of it being ספק יום וספק לילה?

  • Case of a person who sees זיבה two days during בין השמשות
    • רש”י: Every day, בין השמשות could be different. So if a person sees Sunday night and Monday night, it could be Sunday בין השמשות is יום and Monday בין השמשות being לילה. Since there’s a הפסק יום between the two ראיות, it’s only counted as one ראיה, so he doesn’t have the special טומאת זיבה of seven days. If for example both we יום or לילה, it comes out to two ראיות. If for example the first ראיה was partially during day and partially during night, then the ראיה on the next day will make it three ראיות and he’ll be טמא for seven days and have to bring a קרבן.
    • Tosfos in the name of Rashbam: Every בין השמשות is the same. The person saw on Sunday and Tuesday. If both are יום  or לילה, it’s only one ראיה. If one or both were over the course of יום AND לילה, it comes out to three ראיות
    • Tosfos: Every בין השמשות is the same. The person saw on Sunday and Monday. But Sunday was an earlier time than on Monday. Therefore, it’s possible both ראיות were day/night, coming out to two ראיות. Or it could be the first was יום and the second was לילה, coming out to only on ראיה. It could be that the first ראיה was day and night, and the second one was during night, coming out to three ראיות.

  • ר”ת: The שקיעה in פסחים is תחילת שקיעה which only bears halachik significance for דם קדשים being נפסל. The שקיעה of רבי יהודה, is 3 ¼ or 3 1/3 מיל later and lasts until 4/5 מיל after סוף שקיעה.
